Terms of service

1. Who we are

modavio is a business software product operated by DEGTYAREV AND PARTNERS DOO Beograd, a limited liability company registered in the Republic of Serbia (company registration number 21964786, tax identification number (PIB) 114056784, registered address: Jurija Gagarina 231, Unit 329, 11070 Belgrade (Novi Beograd), Serbia) — “we”, “us”. These Terms of Service govern your access to and use of the modavio website, demo systems and the modavio service.

2. The service

modavio is business software assembled from modules (clients and sales, communication, finance, team, online sales, AI and data). It is provided as a cloud service, as a dedicated installation on our infrastructure, or under individually agreed terms, including installation on the customer’s server. The scope of modules, the delivery option and the price are set in the order, offer or individual contract.

3. Accounts and demo systems

• You must provide accurate information when requesting a demo or creating an account and keep your credentials confidential.
• Demo systems are provided free of charge for evaluation, “as is”, and may be reset or deleted after the trial period.
• You are responsible for all activity under your account and for the actions of users you invite.

4. Your data

Data you enter into modavio remains yours. We process it only to provide the service, on your instructions, as a processor; details are set out in our Privacy Policy and, on request, in a data processing agreement. You can export your data at any time, including when moving from the Cloud to a Dedicated installation.

5. Acceptable use

You must not use the service to break the law, send spam, infringe the rights of others, attempt to gain unauthorised access to the service or other customers’ data, or interfere with its operation.

6. Fees and payment

• The price depends on the connected modules and actual usage, as stated in the offer or contract.
• Invoices are issued by DEGTYAREV AND PARTNERS DOO Beograd. Prices are stated exclusive of VAT unless indicated otherwise.
• If payment is overdue, we may suspend access after prior notice; your data is kept during the suspension.

7. Availability and updates

We make reasonable efforts to keep the service available and secure. Cloud updates are installed automatically; Dedicated installations are updated when you choose. Planned maintenance is announced in advance where possible.

8. Intellectual property

The modavio software, design and trademarks belong to us or our licensors. You receive a non-exclusive, non-transferable right to use the service for the duration of your subscription or contract.

9. Liability

To the extent permitted by law, we are not liable for indirect damages or lost profits, and our total liability is limited to the fees paid by you for the service during the 12 months before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited under the law of the Republic of Serbia.

10. Termination

You may stop using the service at any time. On termination, you can export your data within 30 days, after which it may be deleted, unless the law requires us to keep it longer.

11. Governing law

These terms are governed by the laws of the Republic of Serbia. Disputes are resolved by the competent court in Belgrade, unless mandatory consumer protection rules provide otherwise.

12. Changes

We may update these terms. We will notify registered customers of material changes in advance; the current version is always published on this page with its effective date.
